Babcock Responds To City Complaint
In response to a public meeting last week held by city’s code enforcement officer Lawrence Clifford, former city councilman Kyle Babcock reached out to local media saying he never received notification of the hearing. (See related)
“I think the city of Warsaw has some explaining to do,” Babcock said in a letter to StaceyPageOnline.com. “I never received a notice about this hearing from the city of Warsaw. My family and I moved out of this mold filled house over 5 years ago after two court ordered mediations.”
Litigation on the home Babcock had built at 330 Ringneck Trail in Warsaw, began 7 years ago and still, according to the city, has no resolution today. Warsaw’s code enforcement officer Lawrence Clifford said during last week’s hearing, however, that “significant progress” needs to be made by Aug. 18, or he may order the home demolished.
The city held the hearing in Babcock’s absence, but an attorney for lender Indy MAC was present. “As a former Warsaw City Councilman and Warsaw Mayor Candidate in 2011, I’m not hard to find,” Babcock said, irked about not being notified of the hearing.
After reading our report on the meeting, Babcock added, “The attorney at the hearing who supposedly represents the lender made false statements about me and the house. I’ve waited 8 years for justice on this house. I look forward to my day in court. Yes, this house is a tear down and unfixable, as it has been since the day my family and I moved into it in 2006.”
Babcock provided copies of court documents noting, “The city of Warsaw should look up the mediation agreement that I signed that is on file at the court that says all maintenance on this house after we moved out (after June 15, 2009) is the responsibility of the lender, Indy MAC, and the builder who messed it up, Ousley Construction.”
Further, Babcock said, “I’m waiting for them to make the required repairs on the house as they were told to do in the mediation agreement and put it on the market for sale. I’m then required to sign the deed over once they have a buyer for the property. The lawyer for Indy MAC seems to have forgotten the signed Mediation Agreement filed with the court.” (See a photo copy of the signed agreement below)

To read it, click HERE. “Trust me, if I knew there was a code enforcement hearing, I would have been happy to attend and tell them my side of the story,” he said. “I feel sorry for the neighbors in Pheasant Ridge having to deal with this eye sore in their neighborhood. This has been an 8 year nightmare for me and my family.”
The next code enforcement hearing will be at 1:30 p.m. Monday, Aug. 18.
