Burglary, Battery Case On Hold For Woody, DeHart
Charges of burglary resulting in bodily injury and battery by means of a deadly weapon filed against Brandon Woody, Woody, 23, Syracuse, and Kyle D. DeHart, 22, Syracuse, who are both still incarcerated in the Kosciusko County Jail, are on hold, in Kosciusko Superior Court I.
A hearing for a change of venue in the case was held in the judge’s chambers this morning, but postponed indefinitely, until proceedings are determined in Kosciusko Circuit Court, where the two face murder charges.
Scott Lennox, attorney for Woody, stated in the courtroom that this matter and all other matters not relating to the murder charges, will be “pushed out” until there is resolution on the murder charges. According to Lennox, a pre-trial conference is scheduled in the judge’s chambers next week. At that time, he will ask for a hearing date on the change of venue request in the murder. He will also be asking the court to separate the defendants in all matters.
Christanne H. Hampton, deputy prosecuting attorney, stated a conference to determine further dates on this matter will be held at 8:30 a.m. Aug. 31.
The jury trial relating to the battery and burglary charges, which were to begin today, have been vacated.
