Juvenile Receives Probation On Charges
WARSAW — A 14-year-old male, found to be a juvenile delinquent in Kosciusko Juvenile Court, received an undisclosed term on probation Thursday morning. The juvenile was charged with four counts of child molesting.
These charges would be felonies if committed by an adult.
Deputy Prosecuting Attorney Christanne Hampton stated she concurred with the probation department’s recommendation as the predisposition report showed the juvenile had no prior juvenile history or criminal involvement. He would also be closely monitored by probation and his parent.
John Barrett, attorney for the teenager, stated this was a rare occasion where he completely agreed with the state. “In getting to know him, he does not feel good about this,” stated Barrett, unlike most juveniles appearing in juvenile court. “This has been crushing.”
David Cates, juvenile court judge, acknowledged the fact the teen accepted his responsibility for his actions. “Are you aware if there were to be any occurrences or similar charges, you could be waived to adult court and charged as an adult?” Cates stated such a charge, as an adult, could carry up to 12 years in jail. “I don’t think you want that to happen.”
Cates continued stating “from what I read and heard, you can conform” to proper actions accepted by society. It was also noted the teen has been undergoing counseling and the judge ordered it to continue. “I believe it is beneficial. If you work with probation, you can make it happen,” stated Cates, concluding “you make the choice. I hope you don’t make it back here.”
