WARSAW — An 18-year-old Warsaw teen, who was 17 years old when charges were initially filed, was waived to adult court Tuesday, Feb. 16, on multiple charges.

Derek Shea, 18, 1815 Hepler Drive, Warsaw, was booked in the Kosciusko County Jail at 2:16 p.m. Tuesday and released on his own recognizance.

Court documents show the charges against Shea are two counts of dealing in marijuana, both level 6 felonies; possession of paraphernalia, a class C misdemeanor; and possession of schedule I, II, III or IV controlled substance, a class A misdemeanor. Original charges, in juvenile court, were filed in December 2015.

The waiver document states Shae was over the age of 16 at the time of the alleged acts and there was probable cause to believe he committed the acts of dealing marijuana and possession of paraphernalia, which would be offenses if committed by an adult. Documents also state by reason of his age, he is beyond rehabilitation under the juvenile justice system and it is in the best interest of Shae and the community he stand trial as an adult.

Shae will have an initial hearing in Kosciusko Circuit Court at 8:30 a.m. Thursday, Feb. 18.
