Petition For Motocross Track Denied By BZA
WARSAW — During its regular monthly meeting Tuesday, March 8, in Warsaw, Kosciusko County Board of Zoning Appeals considered a petition by Patrick and Darcy Tranter for a home based business, in this case a motocross track, on CR 925E, north of CR 250N in Tippecanoe Township.
Matt Sandy, assistant planning director for the county, noted the Tranters had asked for the petition to be withdrawn but the board decided to consider the petition anyway due to the presence of several remonstrators. Those objecting to the petition expressed concern about potential noise, increased traffic and a negative effect on property values. In addition, a representative from Yogi Bear Jellystone Park, about one mile to the south of the proposed track, expressed concerns about the amount of noise that could be generated.
The petition was denied by the BZA.
In other business, the BZA also denied two petitions from Davidsen’s Pier Service & Sales to allow boat lift/pier installation, sales, service and repair, as well as allowing the storage of towed vehicles in transit. The property is located on the south side of Syracuse-Webster Road, west of CR 620E in Turkey Creek Township.
Remonstrators expressed concern the business would not be compatible with the area. An excavating business had been in the area previously.
Other agenda items included:
• Stephen Fuller’s petition for a variance to allow the placement of a mobile residence closer to the right of way than normally allowed by ordinance was tabled until the April 12 meeting. The BZA questioned the setbacks and requested a survey be done. The property is located on the east side of EMS B58 Lane at the intersection with Barbee Road in Tippecanoe Township.
• Steven and Bridget Johnson were granted a variance to allow a residence to remain as placed 30.1 feet from the right of way when the permit was issued for 35 feet on the west side of Camelot Trail, north of LaPoint Drive in Van Buren Township.
• Randy Richardson was granted a variance to permit decking to remain as built 20 feet from the water’s edge and 1 foot from the east property line on the north side of EMS B42E Lane, south of EMS B42 Lane in Tippecanoe Township.
• Indiana Factory Outlet Marine was denied an exception for the purpose of allowing marina sales and display on SR 13 at the intersection with Backwater Road in North Webster. Not being compatible with the surrounding area and safety were cited as reasons for the denial of the petition. Prior to the meeting, Town Marshal Greg Church provided input, too, and cited poor visibility.
• True Purpose Ministries was granted an exception to allow a Biblical and practical training rooming house for up to 13 residents and a variance to allow a church and rooming house on the same tract of land. It will be located on New Life Christian Church and World Outreach property on CR 325E in Wayne Township, but is a separate entity from the church. Men will live in the rooming house for one year to receive Biblical training.
• Tippecanoe Lake Country Club, EMS T36 Lane in Tippecanoe Township, was approved for the Tiki bar and service area. Approval was given last year for the period of one year and this time approval was given with no time restrictions.
