Charges Filed Against Davis After May Traffic Stop
WARSAW — Benjamin F. Davis III, 26, 765 E. Clark St., Warsaw, has been arrested on a charge of possession of paraphernalia and driving while suspended, both class A misdemeanors. The charge of possession of paraphernalia was enhanced to a level 6 felony, due to a conviction on Jan. 13, 2012, for an offense involving paraphernalia.
He was arrested Monday, March 14, on a warrant from a May 21, 2015, traffic stop. The warrant was issued on June 11, 2015.
Court documents state on May 21, Warsaw City Police Officer Ross Minear observed a Chevrolet Cavalier turn right and accelerate very quickly. Minear followed the vehicle and on two occasions observed the driver fail to signal a turn. He initiated a traffic stop.
Davis provided Minear with his name but provided a false date of birth. He did however, tell police he had a suspended driver’s license and that he had several pieces of marijuana cigarettes left over in his ashtray, having smoked the cigarettes earlier in the day. K-9 Officer Mako was called to the scene to conduct an outer air sniff of the vehicle and positively alerted to the presence of illegal narcotics inside the vehicle.
A search of the vehicle located three partially burned pieces of marijuana cigarettes in the ashtray and a glass smoking device with burnt residue.
He is being held on a $2,000 surety bond for the possession of paraphernalia charge and a $450 cash bond for the driving while suspended charge.
