Man Charged with Invasion of Privacy, Stalking

KOSCIUSKO — A South Whitley man is in custody after violating a protective order of a Winona Lake woman.
Dustin M. Boardman, 32, 305 W. Collamer Rd., South Whitley, is facing two charges for stalking, a level 5 felony, and invasion of privacy, a class A misdemeanor.
According to the affidavit of probable cause, on July 31, an officer with Winona Lake Police Department met with a woman who advised she had dated Boardman for three years and they had broken up two years ago. The woman advised that Boardman had recently been sending her messages that he would “ruin her life” with photographs of her he possessed. Boardman had also began showing up at her place of employment to speak with her. The woman advised she had told Boardman she had no interest in communicating, but he would drive around her residence and wait in her work parking lot to attempt to speak to her.
According to the affidavit, on Aug. 3, the woman obtained a protective order against Boardman. The order prevents Boardman from harassing, annoying, telephoning, contacting or directly or indirectly communicating with the woman. The order also states Boardman is to stay away from the woman’s residence and place of employment. The protective order was served to Boardman by a Whiltey County Sheriff’s Officer on Sept. 1.
On Sept. 10, a Winona Lake Police Officer responded to a violation of a protective order at the woman’s residence. The officer spoke with the woman and she advised that Boardman came to her residence to try and speak with her. She had contacted her boyfriend who came home to find Boardman standing inside the residence’s closed porch attempting to speak to the woman through the door. The boyfriend advised there was a confrontation and Boardman battered him before fleeing.
According to the affidavit, criminal charges were filed against Boardman on Sept. 11, for invasion of privacy and battery.
On Sept. 15, a Warsaw Police Officer responded to a violation of protective order at the woman’s work place. The woman advised she had seen Boardman outside of the building and asked another employee to verify that it was Boardman. The employee advised that Boardman was leaving in his truck. The woman had also asked her boyfriend to check for Boardman.
When officer’s talked to the woman’s boyfriend he advised that the woman had told him she had observed Boardman outside. When the boyfriend went outside, he observed Boardman with a cell phone up to his ear attempting to hide his face. He advised that once Boardman saw him observing him, he got into his truck and fled the area.
On Sept. 27, a Winona Lake Officer responded to an invasion of privacy at the Winona Lake Post Office. The woman advised she was on her way home when a gold or tan colored Oldsmobile with two people in the vehicle drove at her vehicle and blocked her from moving. Boardman exited the passenger side, approached her and stated they needed to talk and that he was willing to seek counseling. The woman recognized the driver who also told the woman she should talk to Boardman.
According to the affidavit, Boardman told the woman he had filed a small claims complaint against her, stating it was not for money but so she would have to talk to him. The woman advised officers that she had received court papers for the small claims hearing. The language used appeared to be of a “controlling nature.”
According to the affidavit, criminal charges were filed against Boardman on Sept. 29, for invasion of privacy and stalking.
Dustin M. Boardman is currently being held at Kosciusko County Jail for invasion of privacy and two charges of stalking with violating a protective order, with bonds of $1,500 cash, $15,750 surety and cash and $2,750 surety and cash.
