Judge Rules In Favor Of The Papers, Stacey Staley
KOSCIUSKO — Two of the defendants were dismissed from the ongoing suit stemming from the 2014 death of Gary Helman.
The Papers Inc. and Stacey Staley were granted a dismissal by Kosciusko County Circuit Court Judge Michael Reed.
The motions to dismiss were presented in court on Nov. 30. The court took the arguments presented under advisement and returned with dismissals this morning, Dec. 5.
In regards to The Papers Inc., Judge Michael Reed declared that “there exists no claim in which relief can be granted.”
During the dismissal hearing, Philip E. Kalamaros, St. Joseph, Mich., argued the motion on behalf of The Papers Inc.
“It is insufficient,” he stated about the information presented. “The Papers Inc. was not there … don’t see a statute or case law regarding mere allegations,” he argued. “There is not sufficient court of law.”
Stacey Staley joined The Papers Inc. motion to dismiss by adopting and incorporating all arguments presented by The Papers Inc. After consideration, the court granted to also dismiss Staley as a defendant.
Bondsmen Tadd S. Martin, Daniel S. Foster and Michael C. Thomas still remain as defendants in the ongoing case.
