On March 12, an officer with the Syracuse Police Department responded to an unknown 911 call. The officer was flagged down by Smith who advised people were out to get him. Smith told the officer that he had smoked marijuana and methamphetamine two days ago.
Approximately 30 minutes later, Smith was pounding on the windows of an undisclosed location. The same officer arrived and spoke with Smith, who now had a Motorola radio sticking out of his left pocket. The officer asked Smith where he obtained the radio and Smith pointed toward South Harkless and East Palm drives. The officer then took possession of the radio.
According to the affidavit of probable cause, the officer went to the area of South Harkless and East Palm drives. The officer spoke with a male subject who advised he was missing a portable Motorola radio. The subject explained that he was working on his truck in the driveway and had left to get parts without locking his vehicle. When he returned, the radio valued at $800 had been stolen from inside his truck.
Smith was booked into the Kosciusko County Jail on April 21 with a $10,250 surety and cash bond.
