Leins, Foreclosures Next Steps In Non-Compliance
MILFORD — Non-compliance on five properties owned by Ron Davidhizar will now have additional fines assessed, liens placed against the property and foreclosure action taken. The discussion was briefly held Monday evening during the May meeting of the Milford Town Council.
Scott Mast, town building commissioner, reported Davidhizer had contacted him requesting the commissioner take a look at the buildings and alleged work that had been done. Mast reported Davidhizer reported receiving an obscene letter from the town and he is trying to adhere to the complaints.
Mast reported putting a 4-inch OSB strip over a broken window was not, in his opinion, boarded up and nothing has been done to a deck or roof. “I don’t see where he met anything that the inspection sheet said he needed to do.”
On another property potential access by rodents and animals into the building has not been resolved. Holes in the soffit, skirting and broken out windows remain and the lawn has not been mowed. “He’s not paying attention to the property,” said Mast, adding Davidhizer asked him for names of high school students willing to mow yards. Mast noted that is not his responsibility.
Joellen Free, clerk-treasurer, noted Davidhizer has asked her on several occasions the same questions. Each time he has been given a list of all businesses offering that service.
Jay Rigdon, town attorney, noted the next step is to assess the costs and numbers and turn it over to the assessor to get a lien on the property and get it foreclosed.
It was among the town council’s first acts of 2017 to fine the owners of six properties, five of those owned by Ron Davidhizer for non-compliance to orders issued back in September 2015. The properties were fined $2,500 each in January. It was noted at that time if the fines went unpaid, the properties would face foreclosure.
The town has been attempting to take action against Davidhizer’s properties since at least October 2016. One of the residences in question has been empty around 15 years.
As noted at Monday evening’s meeting, Davidhizer has only not paid the fines, but also has not complied with the inspection reports.
