Charges Officially Filed Against Dilley
WARSAW — Charges were officially filed against Timothy Allan Dilley, 54, 95 EMS D18A1 Lane, Syracuse, for an incident that occurred Sept. 12 at his residence.
He has now been charged with intimidation with a deadly weapon, domestic battery with moderate bodily injury, pointing a firearm, and criminal recklessness while armed with a deadly weapon, all level 6 felonies; and domestic battery, a class A misdemeanor. He was booked at the Kosciusko County Jail Sept. 12 and held on a $10,250 surety and cash bond.
According to court documents police responded to a call at 4:13 p.m. of shots being fired at the Dilley residence. This was the second complaint of the day in regards to a disturbance at the home. The first complained was received at 2:04 p.m.
The victim, along with one other male and another female, told police they were at that location to retrieve the victim’s personal belongs. According to the male and female, they stayed outside the residence while the victim went inside to retrieve her personal items. A short time later Dilley came out the front door with a shotgun ordering them off his property. He then fired the shotgun over their heads causing leaves and bark to fall on them.
Police were further told by the victim, she had gone to the residence earlier in the day to retrieve her personal items and while there Dilley grabbed her by the neck, pushed her out the door and grabbed a wooden tool handle and hit her on the head and four times on the right arm. She then left. When she returned, in the presence of the two persons, and went inside the home, Dilley pointed a shotgun at her and told her to leave the house.
Dilly did admit to police he left the house with a shotgun and fired it over the heads of the two people, but denied hitting the victim with a wooden tool handle and pointing the shotgun at her. Police did locate a wooden tool handle by the front door with what appeared to have blood on it.
