Brothers Arrested For Intimidation On Christmas Eve
WARSAW — Two brothers are facing charges of intimidation, a level 5 felony, after an incident on Christmas Eve.
Faron Elsworth Erwin, 39, and Frederick Joseph Erwin, 54, both of 707 E. Center St., Warsaw, are both preliminarily being charged with intimidation, a level 5 felony, while Faron is also facing charges of carrying a handgun without a license and pointing a firearm, class A misdemeanors.
According to the affidavit of probable cause, an officer with Warsaw Police Police department responded to an intimidation with weapons in the Combined Community Services parking lot on Dec. 24. The officer met with a male and female victim who advised they had gone to the female’s mother’s residence nearby. The mother became upset with the male subject, shoving him outside. The male and female were waiting outside when the Erwin brothers arrived.
Both victims advised officers that Frederick exited the vehicle holding a baseball bat and Faron a handgun. The brothers were yelling at the male subject to leave. The victims further advised that Faron pointed the gun at the male victim and said, “I’ll f***ing kill you.”
The male victim advised he feared for his life. He entered his vehicle and left the area.
According to the affidavit, when officers spoke to Faron he advised that Frederick did have a bat but that he did not hit anyone. He also admitted to holding an unloaded gun but stated he did not point the gun at the male victim.
Faron was taken into custody and an unloaded Smith & Wesson handgun was found in his waistband. It was noted that Faron does not have a permit to carry a handgun in the state of Indiana.
Frederick advised that the bat was in the vehicle and gave officers permission to obtain it.
The brothers were booked into Kosciusko County Jail on Dec. 24 and each held on $5,250 surety and cash bond.
