North Webster Man Arrested After Battering A Female While Drunk
NORTH WEBSTER — A North Webster man was arrested after he grabbed a female victim by the hair and threw her to the ground. The man’s blood alcohol level registered at .127 percent when police responded to the scene.
James David Byrd, 41, 312 W. Crystal Flash Road, Lot 13, North Webster,is being charged with domestic battery causing serious bodily injury, a level 6 felony, and domestic battery, a class A misdemeanor.
On March 1, an officer with the North Webster Police Department responded to a domestic battery call. The officer located the female victim and observed bloody tissues along with swelling to the victim’s lip and nose.
The female victim advised that Byrd had been drinking and they were arguing. At one point during the argument, Byrd grabbed the victim by her hair and threw her to the floor. The victim sustained injuries and pain from the incident.
Byrd had left the residence after the battery occured. The officer was able to locate Byrd who advised that there was no altercation between himself and the victim. The officer showed Byrd pictures of the victim’s injuries and he continued to deny the altercation.
According to the affidavit of probable cause, the officer noticed that Byrd was unsteady on his feet, had bloodshot eyes and had slurred speech. A portable breath test was administered and Byrd registered at .127 percent.
Byrd was booked into Kosciusko County Jail and held on a $5,250 surety and cash bond.
