Papa John’s Named In Lawsuit Stemming From Accident
WARSAW — Papa John’s, Warsaw, and one of its drivers, Katiana Rodriguez, have been named in a lawsuit stemming from a Jan. 24 accident on East Center Street, Warsaw.
According to the complaint filed March 28, Sabra McInturff’s vehicle was struck by a vehicle driven by Rodriguez, as Rodriguez was leaving the Papa John’s parking lot, at 2511 E. Center St., Warsaw. McInturff reportedly was injured in the accident.
The complaint for damages states the collision was caused by the carelessness and negligence of Rodriguez in the operation of her vehicle for failing to maintain and keep a reasonable and proper lookout, failing to maintain control of her vehicle and failing to yield the right of way. Papa John’s is included in the complaint as Rodriguez was an employee of the company at the time of the accident.
Counsel for McInturff states she sustained physical injuries, which may be permanent and suffered and continues to suffer ongoing physical pain as well as her vehicle was damaged and depreciated in its fair-market value. She also incurred hospital and medical expenses, which may also be incurred in the future as well as the loss of a whole and useful life.
McInturff is seeking an amount to compensate her for the injuries and damages.
Accident Report
McInturff, 23, North Center Street, North Webster, complained of pain to the knee/lower leg/foot, following a three-vehicle accident at 5:26 p.m. Wednesday, Jan. 24. The accident was at East Center Street, west of North Parker Street, Warsaw. McInturff was taken to Parkview Hospital, Warsaw.
Rodriguez, 18, East CR 200N, No. 127, Warsaw, told police she was leaving the Papa John’s parking lot and entering the westbound traffic on East Center Street after another driver in traffic waved her on. When she entered the westbound traffic lane and started to merge into the left turn lane, her vehicle struck the McInturff vehicle. The Rodriguez vehicle continued westbound and hit the back of a vehicle driven by Colleen L. Taylor, 56, North CR 400W, Warsaw.
Damage was estimated up to $10,000.
