Official Charges Filed Against Miller In Sept. 26 Officer-Involved Shooting
WARSAW — Official charges have been filed against a Warsaw man after he attempted residential entry and charged at an officer on Sept. 26.
Kyle Lee Miller, 31, 1823 Cambridge Drive, Warsaw, is being charged with attempted residential entry, a level 6 felony; battery to a law enforcement officer, a level 6 felony; and two counts of resisting law enforcement, both class A misdemeanors.
On Sept. 26, Officer Daniel Clemens responded to a report of an unwanted subject at a residence. A female subject advised a person she did not know attempted to enter her residence. She provided a description of the subject to Clemens.
According to the affidavit of probable cause, the female confronted the male subject, identified as Miller. Miller told the female he wanted a drink of water. The female told him to get the water from a nearby garden hose. After Miller drank from the hose, he then went to the front door and was told to leave the residence. Miller then went to the side door and attempted to enter that door and was told to leave again.
The probable cause affidavit states that Clemens located a subject on Lake Street that matched the female’s description. The subject, identified as Miller, fled from Clemens and refused to obey any commands. Miller grabbed the door handle of a vehicle that was passing by as if attempting to enter the vehicle.
The officer stated that Miller then took an aggressive attitude and approached Clemens, who used his Taser on Miller. Miller then charged at Clemens and struck him.
Clemens discharged several gunshots at Miller, who continued to charge at the officer. Miller received a gunshot wound to his upper arm. During the altercation, Miller jumped into the back of a passing pickup truck, where he was subdued and then arrested.
Miller admitted to attempting to open the front door of the female’s residence. He also admitted to fighting with Clemens and going for his throat because, according to Miller, “that ends it.” Miller also said he consumed a case of beer and also did methamphetamine and marijuana earlier in the day.
Miller was transported to Kosciusko Community Hospital for treatment of his injuries. At the hospital, while officers were changing handcuffs, Miller resisted and attempted to get the handcuffs under his feet and into the front of his person. Officers were able to restrain Miller and gain control.
