WARSAW — A local man was sentenced to seven years in the Indiana Department of Corrections for two drug-related cases.
In the first case, Shane Andrew Timmons, 32, 322 E. High St., Atwood; also showing an address of 602 N. Harrison St., Syracuse; was charged with possession of methamphetamine, a level 6 felony; and possession of paraphernalia, a class C misdemeanor.
In the second case, Timmons was charged with possession of methamphetamine, a level 3 felony. A charge of dealing in methamphetamine in the second case was dismissed as part of a plea agreement.
On Aug. 3, 2017, a Kosciusko Community Corrections Officer and an officer with the Syracuse Police Department went to Timmons’ residence for a home visit. While searching the residence, officers found a glass smoking device containing a residue that tested positive for methamphetamine.
On Dec. 5, 2018, an officer with the Warsaw Police Department went to an Atwood residence and witnessed a woman make a drug deal of almost 200 grams of methamphetamine.
After witnessing the drug deal, officers obtained a search warrant for the residence. Inside Timmons’ bedroom, officers found 28.9 grams of methamphetamine, scales, and small empty bags. Two women at the residence were also involved in the drug deal.
“Mr. Timmons has accepted and realized that he has an addiction problem,” said Defense Attorney Thomas Wilson. “Eighty percent of his criminal history is related to substance abuse. He was not the target of that investigation in December and has been clean for a long time now.”
“I can’t keep doing this to myself and I want the help to get better,” said Timmons.
In the first case, Judge Michael Reed sentenced Timmons to 324 days at the Kosciusko County Jail for possession of methamphetamine. He was also sentenced to 60 days at KCJ for possession of paraphernalia. All of the charges will be served concurrently. However, Timmons has already served this sentence through jail time credit.
In the second case, Timmons was sentenced to seven years at the DoC for possession of methamphetamine. He has 108 days of jail time credit in the case.
“I’m going to recommend immediate placement in Recovery While Incarcerated when you’re at DoC,” said Reed. “If you’re willing to change and stay sober, I will consider modifying your sentence.”
