Jury Selected In Trial For Driver In Triple Fatal Bus Stop Accident
ROCHESTER — Twelve jury members and two alternates were selected Tuesday, Oct. 15, in the first day of what is expected to be a four-day trial of Alyssa Shepherd, 25, Rochester.
Shepherd is accused of killing three children and severely injuring a fourth in a school-bus related accident that occurred on Oct. 30, 2018.
Six-year-old twins Xzavier and Mason Ingle; and their sister, 9-year-old Alivia Stahl, died at the scene from injuries sustained in the crash. A fourth child, Maverik Lowe, sustained multiple broken bones and internal injuries.
Shepherd is charged with three counts of reckless homicide, all level 5 felonies; passing a school bus while the arm is extended where bodily injury results, a class A misdemeanor; and criminal recklessness where committed aggressive driving results in serious bodily injury, a level 6 felony.
Jury selection started this morning and lasted six rounds. Six men and six women were selected to serve on the jury.
Potential jurors were asked by Fulton County Prosecutor Michael Marrs if they would be comfortable viewing autopsy photos as evidence. Marrs also asked if jurors understood the difference between intentional acts versus reckless behavior.
Defense Attorney Michael Tuszynski asked potential jurors if they could be fair and impartial to both sides of the case, as well as if jurors would take issue with a criminal case if a defendant did not testify on the matter.
A full jury was selected at approximately 2:45 p.m. today.
The trial will continue Wednesday in Fulton County Superior Court at 8:30 a.m.
After jury members are given instructions by Fulton County Superior Court Judge Gregory Heller, opening arguments by both sides and testimony from witnesses will begin.
