Husband, Wife Face Charges Following Altercation With Police
WARSAW — A husband and wife both face charges following an alleged altercation with a Warsaw police officer.
Mark Allen Holbrook II, 42, 920 Anchorage Road #11, Warsaw, and Stacy Ann Holbrook, 44, 2605 CR 10B Road, Bourbon, were both booked at the Kosciusko County Jail on Oct. 25.
Mark Allen Holbrook is charged with intimidation against a law enforcement officer, a level 6 felony; and resisting law enforcement, a class A misdemeanor.
Stacy Ann Holbrook is charged with battery of a law enforcement officer, a level 6 felony.
According to the affidavit of probable cause, on Oct. 25, a Warsaw police officer went to a residence after being advised that Mark Holbrook, who had a federal warrant for his arrest, was at that address.
After the officer arrived at the residence and told Mark Holbrook that there was a warrant for his arrest, Mark Holbrook allegedly pulled away from the officer and yelled for his wife, Stacy Holbrook, to come outside.
Information in the affidavit indicates that Mark Holbrook then pulled his cell phone from his back pocket and attempted to throw the phone toward Stacy Holbrook. The officer tried to stop him, and the cell phone fell to the ground.
According to the report, Stacy Holbrook pushed the officer’s leg out of the way while trying to get to the phone. The officer threw Stacy Holbrook to the ground. It was reported that Mark Holbrook II then pushed the officer and tried to step on the phone in an alleged attempt to destroy evidence.
The officer was able to gain possession of the phone, and both Mark Holbrook II and Stacy Holbrook were placed under arrest. The affidavit of probable cause shows that during the arrest, Mark Holbrook II told the officer he was “hit.” The officer, knowing the man has had some gang involvement, took the statement as a threat.
Mark Holbrook II was booked at the Kosciusko County Jail Oct. 25 on a $5,250 cash bond. Stacy Holbrook was booked at the Kosciusko County Jail Oct. 25, on a $5,250 surety and cash bond.
