Winona Lake Man Arrested In Domestic Battery Case
WARSAW — A Winona Lake man faces multiple charges including alleged domestic battery.
Edward Earl Smith Jr., 43, 413 Wooster Road B, Winona Lake, was arrested for domestic battery: moderate bodily injury, a level 6 felony; domestic battery with a child under 16 present, a level 6 felony; domestic battery, a class A misdemeanor; and criminal mischief, a class B misdemeanor.
On July 15, an officer with the Kosciusko County Sheriff’s Office responded to a report of domestic battery at an undisclosed residence in Kosciusko County. The officer found a woman with a bloody lip, cuts inside her lower lip and contusions on the side of her right eye and left arm upon arriving at the scene, according to an affidavit of probable cause.
She said Smith Jr. came to her home to return some of her belongings. They began arguing, she said, and she shut the door on Smith Jr. He then kicked the front door open, causing damage up to $750. She said Smith Jr. punched her in the face several times, grabbed her by the hair and pulled her down the front steps.
A friend of the woman was at the residence during the battery. The witness said she told the child to go to the bedroom when Smith Jr. and the woman started arguing. The witness confirmed the woman’s account of the incident. After Smith Jr. pulled the woman down the front steps, the witness went outside. She saw Smith Jr. punching the woman while on top of her. She said she pulled Smith Jr. off the woman to stop the fight.
A warrant was issued for Smith Jr.’s arrest. A no-contact order with the woman was established by the Kosciusko County Court.
Smith Jr. was booked in the Kosciusko County Jail, Wednesday, Dec. 4 with a bond of $6,000 surety and cash.
