Man Receives Prison Time After Police Chase, Drug Discovery
WARSAW — A man will serve a little more than six years in prison for two criminal cases that occurred in April 2018.
In the first case, Cody Lee Bade, 28, Noblesville, was charged with resisting law enforcement and failure to appear, both level 6 felonies; and driving while suspended, a class A misdemeanor. Bade was also charged with possession of methamphetamine, a level 4 felony; possession of paraphernalia, a class C misdemeanor; and failure to appear, a level 6 felony, in the second case.
Bade was sentenced in Kosciusko Circuit Court on Monday, March 2.
On April 1, 2018, a Kosciusko County Sheriff’s deputy saw a vehicle traveling faster than the posted speed limit in the area of East Old Road 30 and CR 225E, Warsaw. The officer activated his emergency lights when the vehicle, operated by Bade, turned west onto Kosciusko Drive and accelerated at a high rate of speed.
According to court documents, the vehicle continued through Warsaw, reaching speeds of 80 mph while disregarding stop signs and stoplights. The pursuit then continued into Whitley County and came to a stop after officers deployed stop sticks in the roadway. It was discovered that Bade’s Indiana driver’s license was suspended prior.
On April 18, 2018, an officer with the Warsaw Police Department saw a vehicle fail to properly signal a lane change. The officer saw multiple paper and plastic objects being thrown out of the vehicle. As the officer approached the vehicle, he discovered that Bade was a passenger in the vehicle.
While searching the vehicle, the officer found a set of digital scales with a white powder residue and a glass smoking device on Bade’s side of the vehicle. The officer also discovered methamphetamine in the vehicle.
“Cody has been in custody for the last two years and has had no issues while being incarcerated,” said Defense Attorney Scott Reust. “He’s focusing on being clean and sober.”
“I really do want to stay clean,” said Bade.
In the first case, for resisting law enforcement, Kosciusko Circuit Court Judge Michael Reed sentenced Bade to one year in prison. He also sentenced Bade to one year in prison for failure to appear and a one-year suspended Kosciusko County Jail sentence for driving while suspended. In the second case, Reed sentenced Bade to five years in prison for possession of methamphetamine and one year for failure to appear. He also gave Bade a 60-day suspended sentence for possession of paraphernalia. The sentences imposed in this case for possession of methamphetamine and possession of paraphernalia will be served concurrently.
Both cases will be served consecutively. Bade also has 524 days of jail time credit in these cases, which includes good time credit. In total, Bade was sentenced to eight years in prison, with one year and 60 days of that suspended on probation.
