Woman Convicted Of Dealing Could Avoid Prison Time
WARSAW — A Warsaw woman received a suspended sentence pending her acceptance into work release after dealing methamphetamine and heroin.
Rachael Elizabeth Fruit, 27, 547 S. Harding St., Warsaw, was charged with dealing in methamphetamine and dealing in a narcotic drug, both level 5 felonies; and possession of paraphernalia, a class C misdemeanor.
Fruit was sentenced in Kosciusko Circuit Court on Monday, March 2.
On Nov. 28, 2017, an officer with the Warsaw Police Department received information that Fruit was wanted on a warrant and was at a residence in Warsaw. While apprehending Fruit, the officer saw a glass smoking device, cut straws and crushed powder. While searching the residence, the officer also found money, three bongs, two digital scales, a plastic bag containing meth, a drug ledger, four plastic bags containing a white residue and a plastic bag containing heroin.
The officer also obtained a search warrant for Fruit’s cellphone, which showed that Fruit was one of three individuals at the residence who were selling methamphetamine and heroin.
“She’s been doing really well and is ready to show the community that she can continue down this path,” said Defense Attorney Karin McGrath.
For dealing in methamphetamine, Fruit was sentenced to two years in prison. She was also sentenced to two years in prison for dealing in a narcotic drug and 60 days in the Kosciusko County Jail for possession of paraphernalia. The sentences imposed for dealing methamphetamine and possession of paraphernalia will be served concurrently. Reed suspended the entire sentence pending Fruit’s acceptance into work release. If she does not get accepted into the program, Fruit will have to serve four years at DoC.
Fruit also has 393 days of jail time credit in this case, with good time credit as calculated.
