13-Year Sentence Ordered For Criminal Confinement

WARSAW — A Warsaw man will serve 13 years in prison on charges related to gang activity after battering and threatening a man.
In the first case, Brady Dean White, 45, Warsaw, was charged with possession of methamphetamine, a level 6 felony; and resisting law enforcement, a class A misdemeanor. He was also charged with criminal confinement while armed with a deadly weapon, a level 4 felony; and a habitual offender enhancement in a second case. Nine additional criminal charges were dismissed as part of a plea agreement.
White was sentenced in these cases on Monday, Oct. 25, in Kosciusko Superior Court One, with Special Judge Torrey Bauer presiding.
White’s co-defendant in the second case, Brandon Mulldune, 33, Warsaw, was sentenced to nine years in prison last week.
On Aug. 21, 2020, a Warsaw Police officer was on patrol when he saw a passenger car with a temporary license plate. Upon checking the plate, the officer discovered the license number returned to a different type of vehicle.
The passenger car then began speeding and pulled into an alley. White exited the vehicle and began to flee on foot but was apprehended by the officer.
White told the officer that he was a passenger in the vehicle. A K9 unit at the scene alerted to illegal drugs in the vehicle. Upon searching the vehicle, officers found a case of eight syringes and a bag of methamphetamine.
On Sept. 6, 2020, Warsaw Police officers went to the Kosciusko County Sheriff’s Office Work Release Center regarding a distressed man fleeing from people trying to harm him. Upon arrival, officers met with the man, who said he was staying at the Deluxe Inn. According to court documents, a woman and a man who was later identified as White, showed up at his hotel room. The trio then left the hotel and went to White’s residence.
While at White’s home, Mulldune hit the man in the face, head and body with a gun. The man said that during the battery, there were times when White also hit him with the firearm.
He told officers he was forced to go to a friend’s residence in Palestine to get property to give to both White and Mulldune. Eventually, the group drove to the Phillips 66 gas station in Warsaw to pick somebody up; the man then fled the vehicle and ran to the work release center.
Officers spoke with the woman who was with White at the time of the incident. She said she went to the Deluxe Inn to pick up the man since they were going to go to South Bend to try and purchase drugs. After failing to get a check cashed, the man said they would take the television from the hotel room and trade it for a gram of heroin. The man took the television and the three of them went to White’s residence.
While at White’s home, the woman said White pointed a firearm at her. She witnessed both White and Mulldune beating the man and said White beat the man on the head, face and body with a firearm. At one point, White grabbed the man by the throat. The woman said the beatings were extremely violent and that both White and Mulldune were yelling at the man with criminal gang terminology.
The woman told officers that White and Mulldune wanted recompense from the man. White and Mulldune had the woman drive them and the man to a residence in Palestine. The group then went to the Phillips 66 gas station to pick up the woman’s boyfriend. While at the gas station, the man was able to open the door and flee from the vehicle. As the man fled, White grabbed and tore the man’s shirt, trying to keep him from exiting the vehicle.
From this and prior investigations, officers were aware that White is affiliated with the Aryan Brotherhood criminal organization and Mulldune is affiliated with the Dirty White Boys criminal organization. Based upon information provided by witnesses, officers believed the beating was punishment for interfering with the activities of criminal organizations that both Mulldune and White are affiliated with.
Mulldune told officers in an interview that the man was beaten and pistol whipped by White. At one point, White put a gun in the man’s mouth and threatened him.
White is classified as a serious violent felon, having been convicted of trafficking with an inmate in Wabash County in August 2012.
During court proceedings, Defense Attorney Anthony Churchward said that White has a substantial criminal history but that most of it coordinates with substance abuse problems.
“I ask that you don’t give up on Mr. White and get him help with his addiction issues,” said Churchward. “Recognize his acceptance of responsibility and getting a handle on his addiction.”
“There’s no excuse for the harm I caused (the victim),” said White. “I was aggravated enough that I assaulted him.”
For criminal confinement while armed with a deadly weapon, Judge Bauer sentenced White to 12 years in the Indiana Department of Corrections. Five years on that charge were ordered to be executed and seven years were suspended on formal probation. White was also sentenced to eight years in DoC for the habitual offender enhancement. Both charges will be served consecutively.
White was sentenced to one year for each of the two charges in the August 2020 case, with both charges to be served consecutively. However, the case in its entirety will be served concurrently, or at the same time as, the September 2020 case.
In total, White will serve 13 years in prison and seven years on probation.
White has 415 days of jail time credit. He was also recommended for DoC’s Recovery While Incarcerated program.
A no-contact order between White, Mulldune, the man and the woman remains in effect.
