Warsaw Man Arrested On Confinement, Battery Charges

WARSAW — A Warsaw man was recently arrested on three criminal charges following a domestic incident.
Brandon J. Elmenhurst, 28, 4205 Heron Blvd., Warsaw, is charged with criminal confinement, a level 5 felony; domestic battery with a child under 16 present, a level 6 felony; and invasion of privacy, a class A misdemeanor.
On March 5, Warsaw Police officers responded to a report of an intoxicated person. Upon arrival at the scene, officers found Elmenhurst, who was showing visible signs of intoxication. When asked what was going on, Elmenhurst allegedly said he got into a verbal argument with a woman.
According to court documents, Elmenhurst claimed that the woman took his keys and put them in her pocket. He said after the woman got his keys, she left the area.
One of the officers then spoke with the woman, who was waiting nearby. She said she went to pick up Elmenhurst from a local hospital because he got drunk and fell into a table, causing him to have a concussion. While on the way home from the hospital, Elmenhurst told the woman to stop and get alcohol, which she did because she was afraid he would get upset if she didn’t.
The woman told officers while on the way home, Elmenhurst consumed four shots of liquor very quickly. She said an argument started at a residence because Elmenhurst was screaming at four children at the scene.
When she decided to take the children and leave, Elmenhurst allegedly became enraged and flipped furniture in the residence. All four children were there when this occurred. While they were trying to leave, Elmenhurst slammed the woman against a door and grabbed her right arm. Three of the children were able to leave the home and went to a neighbor’s. The neighbor came to the home and pushed their way in, saying that one of the children was still there.
The neighbor was able to get the child out of the home, who was hiding by a freezer, crying and scared. When the woman tried to leave and join the children, Elmenhurst grabbed her and shoved her back into the home. The woman sustained scratches to her right arm and a red mark on her back from the altercation. Eventually, the woman was able to leave.
Officers then spoke with the neighbor, who said their kids were outside playing when they came inside and said that Elmenhurst and the woman were fighting. Three of the woman’s children came to the neighbor, who then went to the woman’s apartment to get the fourth child. The neighbor witnessed Elmenhurst preventing the woman from leaving by shoving her back into the home. They also noticed injuries to the woman’s back and arm.
A portable breath test from Elmenhurst resulted in a .22 BrAC.
At the time of this incident, Elmenhurst was on pretrial release for battery resulting in bodily injury to a person under 14 years of age and public intoxication. The victim in that case is one of the children who was at the home on March 5. There is a no-contact order prohibiting Elmenhurst from having contact with the child.
Elmenhurst was booked in the Kosciusko County Jail on March 5, with a $16,000 surety and cash bond.
