Warsaw Man Receives Three-Year Sentence In Two Cases

WARSAW — A Warsaw man received a three-year sentence in two criminal cases.
In the first case, Brock Anthony O’Brien, 35, 701 W. Winona Ave., Warsaw, was charged with possession of methamphetamine, a level 6 felony; and possession of paraphernalia, a class C misdemeanor. He was also charged with failure to appear, a level 6 felony, in a second case. Five additional criminal charges were dismissed as part of a plea agreement.
O’Brien was sentenced in Kosciusko Circuit Court on Monday, June 6.
On May 21, 2021, a Milford Police officer noticed a vehicle fail to fully stop at a stop sign. The officer pulled the vehicle over and identified its driver as O’Brien.
According to court documents, a K-9 unit at the scene alerted to the presence of illegal drugs in the vehicle. While searching the vehicle, officers found 20 grams of methamphetamine and a small bag with methamphetamine residue. They also found drug paraphernalia.
O’Brien said all of the drugs and paraphernalia in the vehicle belonged to him.
For possession of methamphetamine, Kosciusko Circuit Court Judge Michael Reed sentenced O’Brien to 2 1/2 years in the Kosciusko County Jail, with the first year ordered to be executed and the remaining time served on formal probation. On the paraphernalia possession charge, O’Brien received a two-month sentence at the KCJ. The methamphetamine and paraphernalia possession charges will be served concurrently, or at the same time.
For failure to appear, Judge Reed gave O’Brien a six month sentence at KCJ. This case will be served consecutively to the methamphetamine possession case.
O’Brien has 274 days of jail time credit, which includes good time credit as calculated. He can also serve the executed part of his sentence through the county’s work release or community corrections programs.
In total, O’Brien received a three-year sentence, with 1 1/2 years executed and 1 1/2 years on probation.
