Warsaw Teenager Faces Rape, Battery Charges

WARSAW — A Warsaw teenager was recently arrested after allegedly raping and battering a person.
Hector Rosales, also known as Ector Joel Rosales Urbina, 18, 401 N. Washington St., Warsaw, is charged with two counts of rape, both level 3 felonies; and strangulation, intimidation, and battery resulting in moderate bodily injury, all level 6 felonies.
On June 26, Warsaw Police officers responded to a rape report. Officers determined the victim did not speak or understand English, but did speak and understand Spanish. First responders used the Language Line translation service in order to communicate with them.
According to court documents, the victim said they were asleep in a bedroom when they heard a knock on their door. They told officers they did not respond to the knock and instead got up to use the bathroom. Rosales was in their room when they returned.
The victim said they believed Rosales was intoxicated and possibly on drugs. They tried to get Rosales to leave, but he would not leave until they sat down on their bed and gave him a hug. After the hug, Rosales pushed the person back onto the bed and got on top.
When they tried to scream for help, Rosales allegedly put his hand on the person’s throat, causing pain and difficulty breathing. Rosales told them that if they did not stop screaming, he would strangle them.
Rosales then forcibly had sexual intercourse with the person. During the assault, Rosales began getting sick in the room, allowing the victim to grab their phone and call for help.
The victim was taken to a sexual assault treatment center, where a sexual assault kit was completed. The person was still experiencing significant pain in various parts of their body.
One of the victim’s relatives told officers they believed they knew where Rosales was and provided them with a location on East Winona Avenue. An officer drove to the area and found Rosales, who agreed to speak about the incident.
Rosales admitted to being in the room on June 26, but claimed that when he knocked, the victim opened the door and let him in. He said the two of them made out but that he blacked out and could not remember anything else. Later in the interview, Rosales said at some point, their clothes were off and they were having sex. He then said at one point, the victim noticed he was drunk and asked him to stop. Rosales stopped, grabbed his clothes and left the room.
When asked how much alcohol he consumed, Rosales said he drank a quarter bottle of Hennessy, a brand of cognac that is 40% alcohol by volume, and 10 beers.
Rosales was booked in the Kosciusko County Jail on June 27, with a $55,250 surety and cash bond. If he bonds out, Rosales cannot leave the state without written permission from the Kosciusko County Courts.
