Man Involved In Fatal OWI Accident Arrested After Driving Under The Influence

WARSAW — A Wabash man with a prior conviction for operating a vehicle while intoxicated causing death has been arrested after driving under the influence in Warsaw.
Seth Thomas Losher, 35, 7017 W. 250S, Wabash, is charged with operating a vehicle with an alcohol concentration equivalent to 0.15 or more, a class A misdemeanor; operating a vehicle with an ACE of 0.15 or more with a passenger under the age of 18 and neglect of a dependent, both level 6 felonies; and operating a vehicle with an ACE of 0.08 or more with a prior conviction, a level 5 felony.
On Jan. 8, a Warsaw Police officer responded to a report of a vehicle stuck on railroad tracks. The officer identified the vehicle’s driver as Losher and also learned a child was in the vehicle.
According to court documents, Losher said he was attempting to drive home when he fell asleep and ended up on the railroad tracks. The officer noticed Losher was exhibiting signs of intoxication. Losher failed several field sobriety tests and a portable breath test resulted in a .211 BrAC. A certified breath test showed Losher’s BrAC was .162 grams of alcohol per 210 liters of his breath.
Losher was previously convicted of operating a vehicle while intoxicated causing death in Wabash County in September 2011. In that case, Losher was driving in the area of US 24 and CR 300E on Dec. 30, 2009, when a vehicle accident occurred. His vehicle’s passenger, Megan Bailey, 19, Wabash, died from injuries she sustained in the accident. Losher told officers he smoked marijuana four to seven days prior to the accident occurring.
For OWI causing death, Losher received a six-year prison sentence.
In the Kosciusko County case, Losher has already been arrested and released on bond.
