Marshall County Judge Appointed To Kosciusko Councilwoman Kim Cates’ OWI Case

PLYMOUTH — Marshall County Superior Court Two Judge Dean Colvin has accepted his appointment as special judge in a misdemeanor case filed against Kosciusko County Councilwoman Kim Cates.
Cates, 59, Syracuse, is charged with operating a vehicle while intoxicated – endangering a person and operating a vehicle with an ACE of 0.15 or more, both class A misdemeanors.
These charges stem from a March 9 traffic stop a Kosciusko County Sheriff’s Office deputy completed. The deputy noticed a vehicle weaving within its lane and frequently crossing the road’s fog line. Cates was driving the vehicle and failed three field sobriety tests.
She registered a 0.20 BAC.
Whitley County Prosecutor DJ Sigler is overseeing Cates’ case.
Cates is currently set to appear for a pretrial conference at 9 a.m. Thursday, April 25, in Marshall County.
However, just before 10 a.m. Monday, April 22, Sigler and Cates’ attorney, Scott Reust, filed a joint motion to vacate the pretrial conference and set the case for a change of plea and sentencing hearing at 9 a.m. June 14. Court documents state both parties have reached a plea agreement in the case.
