Mentone Man Found Guilty Of Criminal Recklessness

WARSAW — A Mentone man was found guilty of shooting a firearm in a residential area in Mentone.
During a bench trial in Kosciusko Superior Court One on Monday, Sept. 23, Roy D. Case, 71, Mentone, was found guilty of criminal recklessness with a deadly weapon, a level 6 felony. He was found not guilty of pointing a firearm, a level 6 felony.
Following the bench trial, Case was placed on pretrial release, with the court specifying that Case cannot possess any firearms or drink alcohol.
A no-contact order and trespass warning were also entered. Case cannot contact the victim in this case and cannot enter onto the victim’s property.
The state’s case was presented by Deputy Prosecuting Attorney Joseph Sobek. Case was represented by Defense Attorney Elden Stoops.
Case’s sentencing will take place at 10 a.m. Oct. 24, in Kosciusko Superior Court One.
On Aug. 3, 2023, officers with the Kosciusko County Sheriff’s Office and Mentone Police Department responded to a report of shots fired in Mentone. A woman said Case pointed a gun at her home and fired shots into the air.
According to court documents, the woman said two of her relatives were cleaning a vehicle when Case became angry, fired two shots into the air, and left.
Case was exhibiting signs of impairment while being taken into custody. While searching the scene, officers found shell casings and a handgun.
One of the woman’s relatives said he saw Case wave a handgun around and shoot four or five times into the air.
