Brubaker Sentenced on Drug Charges
WARSAW — A Warsaw woman was sentenced for drug charges after being found unresponsive due to intoxication in a running vehicle.
Kaytlin Elline Brubaker, 24, 3484 N. CR 100E, Warsaw, was charged with possession of a narcotic and possession for two or more chemical reagents or precursors with intent to manufacture a controlled substance, both level 6 felonies; and operating while intoxicated, a class C misdemeanor.
According to court documents, Dec. 21, 2015, a Warsaw Police Officer noticed a running vehicle in the CVS parking lot. The female driver, later identified as Brubaker and male passenger, later identified as Brandon Mettler, were both unresponsive. Mettler was exhibiting signs related to heroin influence.
The officer noticed a Mountain Dew can with the bottom cut off and a box of pseudoephedrine in the vehicle.
Officers spoke to Brubaker, who was exhibiting signs of being under the influence of a drug. She admitted to having used heroin two hours previously and twice per day for the preceding two weeks.
Officers used a K-9 to conduct a search around the outside of the vehicle. The K-9 alerted and officers searched the vehicle, finding pseudoephedrine, sodium hydroxide drain cleaner and the Mountain Dew can containing a brown residue that field tested positive for heroin.
Brubaker was transported to Kosciusko Community Hospital and tested positive for morphine and codeine.
Judge Reed accepted a plea agreement. The two drug charges both received one year jail time and the operating while intoxicated charge received 60 days jail time. The judge suspended all three charges and ordered them to be served concurrently on formal probation. Brubaker received 2 day jail time credit.
The court also ordered her driver’s license to be suspended for six months.
“This is meant to be encouragement for you to complete your substance abuse treatment,” said Reed to Brubaker. “Which we both know you need.”
