WARSAW — The dates of Oct. 3-6 have been set for a jury trial on charges against Mickgomery W. Hisey, 26, 153 EMS D24 Lane, Syracuse, stemming from the Christmas Day fatal accident claiming the lives of Kim Conrad, Syracuse, and her son, Stephen Conrad II, and injured Stephen T. Conrad, Syracuse and Brody Jordan, Syracuse.

Hisey has been charged with two counts of causing death when operating a motor vehicle while intoxicated, two counts of criminal recklessness, all level 5 felonies; two counts of causing serious bodily injury when operating a motor vehicle with an ACE of .08 or more and two counts of criminal recklessness, all level 6 felonies and operating a vehicle with an ACE or .08 or more, a class C misdemeanor.

A status conference was held Wednesday, April 19, between the prosecution, Jack E. Roebel, deputy prosecuting attorney, and defense counsel, Antony Garza. During that meeting a jury trial was requested by the defense. Judge Joe Sutton granted the request and set the trial to begin at 8 a.m. Oct. 3-6. Additional dates were also set.

A status conference/bond review has been set for 10:30 a.m. May 30.

The judge set the final pretrial conference for 10:30 a.m. Aug. 15 with all witness and exhibit lists due by June 30. The date of Sept. 6 was also set as the change of plea deadline.

Hisey has been ordered to personally appear for these dates.

The accident occurred at approximately 6:13 p.m. Christmas Day at the intersection known as “Crazy Corners,” CR 1200N and Syracuse-Webster Road, near Syracuse.

Police reported Hisey was westbound and had purportedly been attempting to drag race in the opposite lane of traffic prior to the collision. Deputies report witness statements said Hisey had begun passing another vehicle westbound on a hill crest just prior to the intersection. His vehicle entered into the intersection, hitting a 2016 Pontiac driven by Steve Conrad. Kim Conrad and Stephen Conrad II were passengers in the vehicle driven by Steve Conrad and pronounced deceased at the scene.

Hisey, Jordan and Conrad all had to be extricated from their vehicles. Steve Conrad, who was taken to Lutheran Hospital, Fort Wayne, with numerous injuries and Jordan, a passenger in the Hisey vehicle, also taken to Lutheran Hospital, Fort Wayne, were released a little more than a week after the accident.

Hisey, who was taken to Parkview Hospital, was not released until late January.

Hisey was arrested in late January and held on $100,000 surety bond. However, Jan. 26, the court released Hisey from the custody of the sheriff’s department on his own recognizance to be monitored by the Kosciusko County Community Corrections, pursuant to the standard rules of home detention.
