Buckheit Sentenced On Multiple Charges
Buckheit pleaded guilty to charges of count I residential entry, a level 6 felony, and count III resisting law enforcement, a class A misdemeanor.
Buckheit’s original charges stem from an incident that occurred on April 27. According to the affidavit of probable cause, an officer with the Warsaw Police Department responded to a residential entry and battery on that date.
Upon arrival, the officer spoke with the female victim who advised she was lying on the couch when Buckheit entered her home without permission. Buckheit then allegedly ran at the woman and began hitting her in the head with a can before getting on top of her and striking her three more times.
When the victim observed Buckheit pick up a knife, the victim retreated to a bathroom to call 911. At that time, Buckheit left the residence.
The affidavit states the officer found Buckheit and spoke with her. Buckheit admitted to entering the victim’s residence and battering her. When the officer told Buckheit she was under arrest, she became belligerent and attempted to kick him.
Buckheit was found guilty of the count I, level 6 felony charge of residential entry and sentenced to 1 1/2 years in the custody of the Kosciusko County sheriff, with one year of the sentence suspended. As for the count III resisting law enforcement charge, a class A misdemeanor, Buckheit was found guilty and sentenced to one year in the custody of the Kosciusko County sheriff, with the sentence suspended. The sentences are to be served concurrently. The sentence may be served through Community Corrections, providing Buckheit qualifies and remains qualified. The suspended portion of the sentences are to be served on probation. Buckheit was also ordered to pay court costs and user fees and to have no contact with the victim. She was ordered to Bowen Center for an assessment.
Buckheit also pleaded guilty to additional charges related to a circuit court case. These charges include count II possession of chemical agents or precursors and attempting to manufacture a controlled substance, a level 6 felony, and count IV theft, a class A misdemeanor.
These charges are related to an incident that occurred July 29 when an employee from Warsaw Dollar General called in a theft. He reported witnessing two females enter the store and place items into a purse. The two females then exited the store without attempting to pay for the stolen items. The employee advised officers that the females left in a black vehicle.
An officer with the Warsaw Police Department located the females driving the vehicle near Center Street. The driver failed to use a turn signal and the officer performed a traffic stop on the vehicle.
The driver of the vehicle was identified as Buckheit. While she exited the vehicle, the officer observed a brown purse matching the description given by the Dollar General employee. Inside the purse, the officer located new socks, a Dollar General brand notebook, coloring book, nail polishes and other new, unopened merchandise.
A plastic bag containing a green bottle filled with ammonium nitrate was also found in the purse. An active shaker bottle was located in the back seat of the vehicle. Other items located inside the vehicle included a syringe and an empty cold pack. These items are commonly used together to manufacture methamphetamine.
Regarding cause F6599 in the circuit court, Buckheit was found guilty of count II possession of three or more chemical reagents or precursors and attempting to manufacture a controlled substance, a level 6 felony, and count IV theft, a class A misdemeanor. Buckheit was sentenced to one year in the custody of the Kosciusko County sheriff for the count II, level 6 felony charge. She was sentenced to six months in the custody of the Kosciusko County sheriff for the count IV, class A misdemeanor theft charge, with the sentence suspended. The sentence in this case may also be served through Community Corrections, again under the condition that Buckheit qualifies and remains qualified.
