Whitehurst Sentenced On Battery To A Disabled Man
WARSAW — In August 2016, Casey Whitehurst, 28, Bourbon, was arrested and charged for the battery of a disabled man. He was sentenced on that charge today, Oct. 12, in Kosciusko County Superior Court I.
According to the affidavit of probable cause filed by Kosciusko County Sheriff’s Department, on Aug. 28, 2016, an officer with the Kosciusko County Sheriff’s Department responded to a battery complaint. The victim advised that Whitehurst had arrived at his house highly intoxicated. Whitehurst asked for some pain pills, which the victim takes for a bone disorder, but the victim refused.
Whitehurst became angry and shoved the victim, causing him to fall out of his wheelchair. Whitehurst then stood on the victim’s leg and placed his forearm on the victim’s throat. After that, Whitehurst stood up and hit the victim several times with the wheelchair and shoved the wheelchair down a ramp.
Whitehurst addressed the court, stating that he has been sober and working for the last year. “I can see the light and I just want the opportunity to keep going,” Whitehurst said.
Judge David Cates sentenced Whitehurst to 1 1/2 years at the Kosciusko County Jail for the charge of battery resulting in moderate bodily injury, a level 6 felony. Cates stated he had no objection to the sentence being served on work release or in Marshal County Community Corrections, where Whitehurst is currently serving another case.
Whitehurst has to report to be incarcerated or be enrolled in a correctional program by 4 p.m. on Oct. 20.
