First Two Witnesses Testify In Warsaw Rape Trial

WARSAW — The first two witnesses for the jury trial involving a Warsaw man accused of rape testified on Tuesday, Aug. 6.
Alexander Glen Hurley is facing one charge of rape, a level 3 felony. The incident allegedly occurred in February 2018 in which Hurley was accused of raping a young woman at his residence.
During opening statements, Deputy Prosecuting Attorney Matthew Buehler explained the alleged incident that led to Hurley being charged with rape. According to Buehler, Hurley heard the word “no” from the victim but continued.
“This is a case of a man not taking no for an answer,” said Buehler. “He’s even described himself as a sex addict who didn’t take no for an answer.”
Defense Attorney Jay Rigdon told the jury that Hurley and the victim had sexual intercourse in the past, but that it was consensual.
“The state is going to try and convince you that she [the victim] was raped,” said Rigdon.
The state’s first witness was the victim in the case, who is now 17 years old. In court paperwork, she was referred to as A.A.
A.A. testified that she first met Hurley in 2017 at a football game and that she did not have a crush on him. In February 2018, A.A. said Hurley texted her and asked if she was free to hang out. She told the jury that she went to Hurley’s house and that they were watching a movie while they waited on a friend to arrive. A.A. said she and Hurley were the only people at the residence.
According to A.A., she and Hurley sat on his bed when Hurley grabbed her arm and told her to cuddle him. A.A. told jurors he then asked for a kiss when she forcefully said “no.” Hurley then got on top of A.A. and when she realized Hurley wasn’t going to stop, she just “laid there and afterward, I told him I wanted to go home.” A.A. reported the crime in December 2018 when she told a relative what had happened.
During the cross-examination, Rigdon asked A.A. about an interview she did with Warsaw Police Officer Jacob Metzger about the incident. According to Rigdon, the interview stated that A.A. told her relative about the incident a few days after it occurred.
A.A. said she told her relative that she had lost her virginity but didn’t mention the incident as a rape. She also said she told her mother about the rape the day she spoke with Officer Metzger and that she did not have sexual intercourse with Hurley prior to February 2018.
The second witness was Warsaw Police Department Detective Lieutenant Paul Heaton. Heaton told the jury he interviewed Hurley in December 2018 regarding the incident. The video interview between Hurley and Heaton was shown as evidence in court.
In the video, Hurley admitted that he and A.A. had intercourse approximately two years ago in a vehicle while at a lake. He then said he could not remember where he was the day the incident occurred in February 2018.
A letter of apology that Hurley wrote to A.A. was also submitted as evidence. During cross-examination, Rigdon asked Heaton who else was interviewed in this case aside from Hurley and A.A. Heaton said the only people he interviewed about the case were Hurley and A.A.
Heaton’s testimony was the final witness for the first day of the trial. The trial will continue and is scheduled to conclude on Wednesday, Aug. 7.
