Duran Arrested For Rape, Battery

WARSAW — A Warsaw man was recently arrested for allegedly raping and battering a person.
Kevin Rodriguez Duran, 27, Warsaw, is charged with rape, a level 3 felony; criminal confinement, a level 5 felony; strangulation and domestic battery, both level 6 felonies; and criminal mischief, a class B misdemeanor.
On Aug. 26, Warsaw Police officers responded to a domestic incident. Officers spoke with an individual who said Duran assaulted them. The person had a swollen and bloody lip.
According to court documents, the person said they were laying in bed with two children when Duran entered the room. He appeared intoxicated.
Duran then gave the children cellular devices to keep them occupied and attempted to be intimate with the person. The person said they did not want to have sex. However, Duran forcibly had sexual intercourse with the person against their will.
During the assault, Duran allegedly put his hands around the person’s neck and choked them. He eventually stopped when the person said they did not feel well. When the person attempted to leave the room to get away from Duran, he forced them back onto the bed and had sexual intercourse with them.
As the person called a relative, Duran slapped the phone out of the person’s hand, hitting their face in the process. He also picked up the phone and slammed it on the floor, shattering the phone’s screen. During the brief time the call was connected, the relative witnessed the assault and called 911.
Duran told officers the person said “yes and no” when he tried to have sex with them. He said the person liked it at first and then didn’t. When asked about a physical fight, Duran said he never touched the person.
A portable breath test from Duran returned a result of 0.13% BrAC.
Duran was booked in the Kosciusko County Jail on Aug. 26, with a $21,000 surety and cash bond. As part of his bond conditions, Duran cannot leave Kosciusko County without prior court approval.
