WARSAW — A Warsaw man received a four-year sentence for battering a person in Kosciusko County.
Kevin Rodriguez Duran, 27, Warsaw, was charged with criminal confinement, a level 5 felony; strangulation and domestic battery with a child under 16 present, both level 6 felonies; and criminal mischief, a class B misdemeanor. A Level 3 felony rape charge was dismissed as part of a plea agreement.
Duran was sentenced in Kosciusko Superior Court One on Thursday, March 14.
In total, Duran received a four-year sentence at the Indiana Department of Correction, with two years executed and two years suspended on formal probation. He has 187 days of jail time credit, plus good time credit as calculated.
Kosciusko Superior Court One Judge Karin McGrath said she had no objection to Duran serving the executed portion of his sentence through Michiana Community Corrections.
A no-contact order between Duran and the victim remains in effect.
On Aug. 26, 2023, Warsaw Police officers responded to a domestic incident. A person said Duran assaulted them.
During the assault, Duran put his hands around the person’s neck and choked them. When the person attempted to leave a room to get away from Duran, he forced them back onto a bed. As the person called a relative, Duran slapped the phone out of the person’s hand, hitting their face in the process. He also picked up the phone and slammed it on the floor, shattering the phone’s screen. Two children were present in the home at the time of the incident.
